NichePrism is a trend research and ideation tool, not a legal advisory service.
While we attempt to provide initial risk assessments based on automated data, we DO NOT guarantee that any design prompt, quote, slogan, or trend concept provided by our Service is free from trademark, copyright, or other intellectual property protections.
It is your sole and absolute responsibility as a seller to conduct thorough, independent trademark and copyright analysis before creating, uploading, or selling any merchandise based on our data. NichePrism, its founders, and affiliates are strictly NOT responsible or liable for any seller account strikes, platform suspensions, legal disputes, financial losses, or damages resulting from intellectual property infringement.
3. Use of the Service
NichePrism grants you a non-exclusive, non-transferable, revocable license to access our trend intelligence data for your personal or commercial Print-on-Demand business. You may use the insights and prompts generated by our service to create commercial end-products. However, you may not scrape, resell, or distribute our raw data, API access, or software to third parties.
4. AI-Generated Content
The trends and image prompts provided by NichePrism are generated using a combination of live data, Artificial Intelligence models, and human curation. Due to the nature of AI, information may occasionally be inaccurate or hallucinated. You agree to use the provided concepts at your own discretion and verify the viability of the niche independently.
5. Limitation of Liability
To the maximum extent permitted by law, NichePrism shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; or (b) any conduct or content of any third party on the Service.
6. Modifications to the Service
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service.
